Host agreement

Effective date: June 21, 2026. Version 2.0.

This Host Agreement ("Agreement") is a binding contract between you (the "Host") and FairCar, Inc. ("FairCar") covering your use of the FairCar marketplace to rent your vehicle(s) to Guests. By listing a vehicle on FairCar you accept this Agreement.

1. Vehicle eligibility

  • Host is the registered owner of the vehicle or holds the express written authority of the owner to rent it.
  • The vehicle has a clean (non-salvage, non-rebuilt) title and has not been recalled for an unresolved safety defect.
  • The vehicle is currently registered, has a current safety/emissions inspection where required, and is mechanically sound.
  • The vehicle is covered by an automobile insurance policy that permits commercial or business use of the vehicle outside of rental periods in the jurisdiction where it is registered, in amounts no less than the state minimum. Acceptable forms include commercial auto policies, rideshare/delivery "Period X" endorsements, and peer-to-peer carsharing riders.
  • The odometer reading, year, make, model, and trim displayed in the listing are accurate.

2. Listing accuracy

Host warrants that all photos, descriptions, pricing, mileage allowances, location, pickup instructions, and rules disclosed on the listing are accurate, current, and not misleading. Material misrepresentation entitles a Guest to a full refund and may result in Host account suspension.

3. Mandatory inspections

Host must complete a pre-trip handoff inspection in the FairCar app no more than 24 hours before each trip starts (minimum 4 exterior photos, 2 interior photos, odometer reading, fuel or battery level) and a post-trip inspection within 24 hours after each trip ends. Failure to file the post-trip inspection within 24 hours of trip end auto-releases the Guest's security deposit in full and waives Host's right to file a damage claim for that trip.

4. Fees and payouts

  • FairCar charges a monthly Host subscription, billed only in months that contain at least one completed booking.
  • FairCar does not take a commission or any percentage of the trip subtotal. Hosts keep 100% of their trip earnings (net of payment processor fees and any taxes remitted by the processor).
  • After the trip is complete and the dispute window closes, eligible payouts are queued through our payment processor. Most payouts arrive within 2 to 5 business days, depending on processor verification, bank timing, and disputes.
  • Payouts may be held during a fraud, safety, or dispute investigation and released only after the investigation concludes.

5. Insurance

FairCar does not provide insurance for Hosts. Host is solely responsible for maintaining auto insurance that covers the vehicle for commercial or business use outside of rental periods — for example, a commercial auto policy, a rideshare/delivery "Period X" endorsement, or a peer-to-peer carsharing rider — and for any uninsured loss. Host represents that they have notified their insurer of the commercial use of the vehicle to the extent required by their policy.

6. Damage claims and security deposit

Host may file a damage claim within 24 hours of trip completion through the in-app dispute flow, supported by the pre- and post-trip inspections. Claims are resolved against the Guest's security deposit. Amounts above the deposit are pursued by Host directly against the Guest's personal policy or, where applicable, the at-fault third party's policy. FairCar's role is limited to producing a written Resolution Memo.

7. Cancellations by Host

A Host-initiated cancellation always results in a full refund to the Guest. Host-initiated cancellations within 48 hours of trip start are subject to a $50 cancellation fee debited from the next payout and, if frequent, may result in listing demotion or suspension. FairCar may charge Host for reasonable rebooking costs Guest incurs.

8. Compliance with law

Host is solely responsible for compliance with all applicable laws, including local rental, business-licensing, zoning, parking, and tax laws. Host is responsible for reporting and paying any income tax on rental earnings. FairCar provides earnings statements but does not provide tax advice and is not a withholding agent.

9. Prohibited host conduct

  • No off-platform payments, off-platform bookings, or attempts to divert Guests off the FairCar marketplace.
  • No discrimination based on race, color, religion, national origin, sex, gender identity, sexual orientation, age, marital status, military service, or disability.
  • No sharing of Guest personal information with any third party other than as required by law.
  • No installation of covert recording or tracking devices in the vehicle interior. Exterior dashcams and OEM GPS tracking are permitted only if disclosed in the listing.

10. Suspension and termination

FairCar may suspend or terminate Host's account or any listing for breach of this Agreement, safety concerns, repeated cancellations, repeated low ratings, repeated dispute losses, fraud signals, or for any reason at FairCar's discretion. FairCar may hold pending payouts during investigation of suspected violations.

11. Indemnification

Host will defend, indemnify, and hold harmless FairCar from any claim arising out of Host's listing, the condition of the vehicle, Host's breach of this Agreement, or Host's violation of any law.

12. Governing law and arbitration

The governing-law and arbitration provisions of the Terms of service apply to this Agreement.
